The lawsuit, filed in the U.S. District Court for the Northern District of California on Tuesday, alleges that in April and May of 2019 a technical vulnerability in WhatsApp’s platform allowed attackers to install malware on around 1,400 phones, allowing for covert digital surveillance.

Citizen Lab discovered the vulnerability in WhatsApp after a human rights lawyer contacted the organization about phone calls “at odd hours from an unknown Swedish number.” The lawyer was working for people who had been previously targeted by NSO Group.
